1. Introduction and Agreement

1.1 About These Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and House And Land Packages Pty Ltd (ABN 92 631 641 408) ("HALP", "we", "us", or "our"). By accessing or using any of our websites, platforms, or services, you agree to be bound by these Terms.

For Advertisers (including agents, builders, and developers), these Terms also include the Listing Agreement, which is incorporated by reference. In the event of any inconsistency between these Terms and the Listing Agreement regarding listing specifics, the Listing Agreement shall prevail.

1.2 Our Platforms

These Terms apply to all HALP platforms including www.halp.com.au, www.boutiquedevelopments.com.au, associated mobile applications, and any related websites, features, or services within our network.

1.3 Acceptance of Terms

By accessing or using our services you acknowledge that you have read and understood these Terms, agree to be bound by these Terms and our Privacy Policy, represent that you are at least 18 years of age, and represent that you have the authority to enter into this agreement. If you do not agree with these Terms, you must immediately cease using our services.

1.4 Changes to Terms

We reserve the right to modify these Terms at any time. When we make changes we will update the "Last Updated" date, notify registered users via email, prominently display material changes, and changes take effect immediately upon posting (or as otherwise specified). Your continued use of our services after changes are posted constitutes acceptance.

2. Description of Services

2.1 Platform Services

HALP operates specialized property discovery and business directory platforms providing house and land package listings and searches, off-the-plan property information, new development project details, boutique and luxury property showcases, school zone integration and mapping, property calculators and tools, mortgage broker connections, and property market insights and guides. We also operate a business directory (freemium model) with enhanced visibility for premium subscribers, lead generation and inquiry management, business profile management, and multi-platform advertising reach. Supporting services include property alerts and notifications, saved searches and favorites, mortgage and finance calculators, educational content and buying guides, market research and data, and CRM integration for business users.

2.2 Nature of Service

Information Platform: HALP is an information and advertising platform. We facilitate connections between property seekers and property providers, aggregate and display property and business information, provide tools to assist in property research and decision-making, and are not a real estate agent, developer, builder, or financial advisor.

Lead Routing: When you submit an inquiry about a property listing your inquiry goes directly to the listing agent, developer, or builder. HALP does not store, process, or access property-specific inquiries. The property advertiser is responsible for handling your information. When you use our platform inquiry forms (Contact Us, Join Us, Advertise With Us) your information is collected and managed by HALP; inquiries are stored in our CRM systems (Pipedrive, ActiveCampaign) and supporting information may be stored in Google Drive.

No Agency Relationship: HALP does not act as your agent or representative, provide property, financial, legal or tax advice, have any authority to bind you to any transaction, guarantee the accuracy of third-party listings, or control how listing agents use your inquiry information.

2.3 Service Availability

Services are provided "as is" and "as available". We may modify, suspend, or discontinue services at any time. Scheduled maintenance may cause temporary interruptions. We are not liable for service interruptions or unavailability. Platform infrastructure includes AWS (hosting and backups), Synergywholesale (domain hosting), Google Workspace (business email), Stripe (payment system), Pipedrive and ActiveCampaign (CRM systems), and Zapier (automation). These providers may change from time to time.

3. User Accounts and Registration

You must provide accurate, current, and complete information; maintain the confidentiality of your credentials; be at least 18 years of age; only create one account per person; and provide a valid ABN/ACN for business accounts. You are responsible for all activities that occur under your account. We may suspend or terminate your account if you breach these Terms, provide false information, engage in fraudulent or illegal activities, fail to pay applicable fees, or remain inactive for an extended period. You may terminate your account by contacting support@halp.com.au.

4. User Conduct and Prohibited Activities

You agree to comply with all applicable laws, use services only for lawful purposes, provide accurate and truthful information, respect intellectual property rights, and act in good faith when contacting property providers or businesses.

You must not misuse the platform (bots, scrapers, unauthorized access, reverse engineering, circumventing security), post harmful content (false or misleading information, viruses, spam, phishing, impersonation), engage in illegal activities (violate laws, infringe IP rights, money laundering, fraud), engage in abuse or harassment, or misuse the platform commercially (resell services, compete, aggregate/scrape listings, create multiple accounts).

Violations may result in immediate account suspension or termination, removal of content, legal action, reporting to law enforcement, and permanent ban.

5. Property Listings and Information

Property listings and information are provided and owned by property developers and builders, real estate agents and agencies, project marketing companies, and third-party data providers. HALP does not own or control third-party listings, verify all listing information, endorse any particular property, or guarantee availability or pricing.

Property information may change without notice; prices, availability, and specifications are subject to change; images and renderings may not reflect final product; land sizes are approximate; and school zone information is provided for reference only. Always verify critical information directly with the property provider before making decisions.

School zone data is sourced from government databases and third-party providers, provided for general reference and research purposes only, subject to change based on government policy and enrolment, and not guaranteed to be current or accurate. Always verify school catchment zones directly with the relevant education department and individual schools before making property purchase decisions.

6. Business Directory Listings

To advertise you must hold a valid ABN or ACN, be a legitimate operating business, comply with all applicable business and advertising laws, provide accurate business information, and hold necessary licenses. Listings must accurately describe your services, include current contact information, use your own business name and logo, comply with Australian Consumer Law, and not contain misleading or deceptive claims.

Free listings provide basic directory presence and are subject to availability and acceptance. Premium subscriptions provide enhanced visibility, require monthly or annual payment, are subject to a separate subscription agreement, and auto-renew unless canceled. When you receive inquiries through our platform you must respond promptly and professionally, comply with privacy laws, and honor any representations made in your listing. We may remove or suspend business listings if you breach these Terms, we receive credible complaints, you fail to pay subscription fees, your business is unlicensed, or your listing contains prohibited content.

7. Payment Terms (Advertiser Subscriptions)

Pricing for subscriptions, listings, and other services is as displayed on our website or in the applicable Listing Agreement, and is subject to change with 30 days notice. All fees are in Australian Dollars (AUD) and displayed exclusive of GST unless otherwise stated. Payments are processed via Stripe (PCI-DSS Level 1 certified) with automatic recurring billing for subscriptions, secure encrypted transactions, and no storage of complete credit card numbers on HALP servers.

Subscriptions auto-renew unless canceled. You may cancel anytime before your next billing date; cancellation takes effect at the end of the current billing period. No refunds for voluntary cancellations. Refunds for technical issues preventing service access are pro-rata and processed within 14 business days. If payment fails we will attempt to process payment multiple times, your account may be suspended after 7 days, and your listing may be removed after 14 days.

8. Intellectual Property Rights

All content and materials on our platforms are owned by HALP or licensed to us, including logos and trademarks ("HALP", "House And Land Packages", "Boutique Developments"), website design, software, text, graphics, images, videos, data compilations and databases, and school zone data aggregations.

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use our platforms for personal, non-commercial purposes. You may not reproduce, distribute, or publicly display our content without permission, modify or adapt it, use it for commercial purposes, or remove copyright notices.

When you submit user-generated content you retain ownership but grant us a worldwide, royalty-free license to use, reproduce, modify, and display your content. If you believe content on our platform infringes your copyright, contact legal@halp.com.au.

9. Disclaimers and Limitations

HALP does not provide financial, mortgage, or investment advice. Our calculators provide estimates only and should not replace professional financial advice. We do not provide legal or tax advice — always consult a qualified solicitor or licensed tax professional. We are not licensed real estate agents; we do not provide property valuations, buying or selling advice, or guarantee investment returns.

HALP facilitates connections but does not control the conduct of third parties and is not responsible for their actions. Information may contain errors, be outdated, or change. We do not guarantee continuous, uninterrupted access or error-free operation. Our platform relies on third-party services (AWS, Stripe) and we are not responsible for their failures, though we will make reasonable efforts to resolve problems promptly.

10. Limitation of Liability

To the maximum extent permitted by law, HALP and its directors, officers, employees, and agents are not liable for loss of profits or revenue, loss of data, loss of business opportunities, consequential or incidental damages, special or punitive damages, or any damage arising from your use or inability to use our services, errors or omissions, third-party conduct, unauthorized account access, service interruptions, or property transactions you enter into.

Where liability cannot be excluded by law, our total liability for any claim is limited to $100 AUD for free services, or the amount you paid us in the 12 months prior to the claim (or $1,000 AUD, whichever is less) for paid services. Nothing in these Terms excludes rights under the Australian Consumer Law that cannot be excluded.

You agree to indemnify and hold harmless HALP, its affiliates, and their respective directors, officers, employees, and agents from any claims arising from your breach of these Terms, violation of any law or third-party rights, use of our services, content you submit, or your interactions with other users or third parties.

11. Dispute Resolution

Before initiating legal proceedings you agree to contact legal@halp.com.au with details of your dispute, allow us 30 days to investigate and respond, and engage in good faith discussions. These Terms are governed by the laws of New South Wales, Australia, with exclusive jurisdiction in NSW courts. For disputes not resolved informally, either party may request arbitration under the Australian Dispute Resolution Association (ADRA) rules in Sydney. To the extent permitted by law, disputes will be resolved on an individual basis and you waive the right to participate in class actions.

17.2 Property Listing Inquiry Flow

When you submit a property listing inquiry your information is sent directly to the listing agent/developer, HALP does not store, read, or process your inquiry, the advertiser becomes responsible for your information, the advertiser's privacy policy governs their use of your data, and HALP cannot retrieve, modify, or delete inquiries sent to advertisers.

17.3 Platform Inquiry Forms

When you use our platform forms (Contact Us, Join Us, Advertise With Us) we collect and store your information, information is managed in our CRM systems (Pipedrive, ActiveCampaign), supporting documents may be stored in Google Drive, our Privacy Policy governs this data, and we respond to your inquiry and may follow up.

17.4 User Acknowledgment

By using any inquiry form on our platform you acknowledge that property listing inquiries go directly to advertisers (not HALP), you understand the advertiser will receive your contact information, you should review advertiser privacy policies, HALP is not responsible for how advertisers handle your information, and platform inquiries are managed by HALP per our Privacy Policy.

12. General Provisions

These Terms, together with our Privacy Policy, constitute the entire agreement between you and HALP. If any provision is found invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary and remaining provisions will continue in full force. Our failure to enforce any provision does not waive our right to enforce it in the future. You may not assign these Terms without our written consent. 13. Special Terms for Specific Services

Mortgage Calculators provide estimates only, not pre-approvals, and should not replace professional financial advice. School zone information is aggregated from public government databases, provided "as is", subject to change without notice, and for research purposes only — always verify with the relevant state education department and the specific school. When you subscribe to property alerts you consent to receive emails and SMS notifications. When we connect you with mortgage brokers we may receive a referral fee or commission; brokers are independent third parties, we do not guarantee loan approval, and you are free to use any broker or lender.
